Protection of Personal Data
Protezione dei Dati Personali
The GDPR provides for various sanctions for those who fail to comply with its provisions regarding the Protection of Personal Data.
The sanctions may vary depending on the severity of the violation and the nature of the data involved. CMG briefly outlines the sanctions related to this mandatory requirement.

Some of the key elements regarding sanctions

Administrative Fine. The most well-known aspect of GDPR sanctions is the imposition of administrative fines. Fines can be up to 4% of the company’s annual global turnover or up to 20 million euros, whichever is higher. This is the maximum penalty for the most serious violations, such as failure to obtain consent for data processing or violation of the fundamental principles of data processing.
Lower Fine. For less serious violations, fines can be up to 2% of the company’s annual global turnover or up to 10 million euros.
Reprimand or Warning. In some cases, supervisory authorities may choose to issue a reprimand or warning instead of a fine, especially if the organization has taken immediate corrective measures.
Suspension of Processing Activities. Supervisory authorities may order the suspension of data processing activities when serious and persistent violations are identified.
Compensation for Victims. Data subjects have the right to obtain compensation for damages suffered as a result of GDPR violations.
Civil Liability. Organizations may be subject to civil lawsuits brought by individuals or groups who believe their rights have been violated.
Actual sanctions may vary depending on the specific circumstances of the case. It is important to note that national supervisory authorities are responsible for enforcing the GDPR within their respective European Union member states.
Therefore, procedures may differ slightly from one country to another. Turning to an experienced consulting company such as CMG can be a fundamental step in ensuring efficient and compliant management of the Protection of Personal Data. Protezione dei Dati Personali
